Changes to terms of Global Traveller Legal Assistance Insurance (as of 1 June 2010)

In order to respond as best as we can to our client's wishes and market developments, OOM Verzekeringen has made far-reaching changes to its legal assistance insurance. This page contains further information on these adjustments.

The changes are so far-reaching that this is really an entirely new product. Furthermore, the party processing the claim for OOM Verzekeringen has changed. It was DAS Rechtsbijstand until 1 June 2010. As of 1 June 2010, it will be ARAG Rechtsbijstand.  

The principle behind the changes is that it will be a better product for the same premium. Due to the change of provider, however, it is not possible for everything to remain exactly the same. You may regard what we see as an improvement, as a change for the worse. The appendix will indicate what has changed. Explanation of differences in Global Traveller Legal Assistance Coverage  

Additional coverage

For clients with Top coverage, it will be possible as of 1 June to take out more extensive coverage for a home kept in the Netherlands (Section E). The home cannot be for the policyholder’s own use (but it may, for example, be inhabited by the partner and/or children who stay behind).  The following legal disputes are insured:

  • instituting a claim against a statutorily liable third party;
  • disputes with those whom the insured person has hired to maintain the immovable property;
  • conflicts with one of the neighbours regarding neighbour law provisions, i.e. the rules as set out in Articles 37 to 59 inclusive, Book 5 of the Dutch Civil Code;
  • disputes relating to insurance for the immovable property;
  • disputes relating to a building permit for the insured immovable property;
  • there is no coverage for problems relating to purchasing, selling, renting and/or letting the immovable property, including rental collections etc.

Additional terms Category E

“Ownership of Immovable Property” coverage offers legal assistance in case of legal disputes regarding your property that you do not occupy yourself. This coverage is only effective if you have valid buildings insurance for your property. It is further assumed for the purpose of the insurance that you are the sole owner of the property. Disputes with co-owners are not insured.

 

 A second additional coverage option is for rental of the home kept in the Netherlands (Section F). Section F can be taken out only in combination with E. There must also be a written rental agreement. The agreement must run for at least one year from the effective date of this coverage. The following legal disputes are insured:

  • all disputes with the tenant. A specifically defined legal dispute must however exist. A situation in which the tenant does not dispute that the rent must be paid or only fails to pay because of his or her financial inability to do so is not regarded as a legal dispute;
  • other problems with the authorities regarding permits or dispensations, in addition to those problems that are insured in article 3.9: "Ownership of immovable property".
  • there is no coverage for disputes with those who occupy the property without an agreement with the policyholder, such as squatters and subtenants.

Additional terms Category F

“Letting of Immovable Property” coverage offers legal assistance in case of legal disputes concerning property of yours that you rent out. There must be a written rental agreement which complies with ARAG’s requirements. There is a sample contract on ARAG’s website (www.arag.nl). The coverage is taken out on condition that the rental agreement is entered into with one tenant (no letting rooms / no subletting). The rental contract must also still have at least one calendar year to run when this coverage is taken out.

Premium for (additional) forms of coverage

The annual premiums for the different forms of coverage are given below. Premiums for basic and top coverage are unchanged. These amounts do not include 7.5% insurance tax.

Taking out additional forms of coverage

If you are interested in one of the additional forms of coverage, please e-mail info@oomverzekeringen.nl. Indicate your policy number and the additional coverage you want to take out (Section E or Sections E and F) in your message. Both forms of coverage can be taken out only if you have Top coverage.

Changes to terms of Young Global Traveller Insurance (as of 1 June 2010)

Legal assistance coverage in the Insurance Package has changed. The policy terms are the same but if legal assistance is to be provided, this will now be done by ARAG Rechtsbijstand.

 As of 1 January 2010 the policy terms and conditions of the Global Traveler Insurance and Young Global Traveler Insurance will change. The terms and conditions of the Global Visitor Insurance will change as of 1 februari 2010. Below you'll find a summary of the changes.
